Terms of service
Last updated 1 November 2026
These terms are an agreement between you and Kharon Labs (“we”, “us”) and govern your use of Kharon Labs: our website, the console, the snippet and SDK, and related APIs (the “service”). By creating an account or using the service you accept them. If you use the service for an organization, you accept them on its behalf and confirm you have authority to do so; “you” then means that organization.
The service
Kharon Labs lets you show each visitor to your website content written for who they are, and measure the result against a holdout group. We may add, change or remove features. The service is in active development, and features we label as preview or beta may change or stop working without notice.
Your account
- You sign in with a Google or GitHub account and must be at least 16 years old.
- Keep access to your sign-in accounts secure. You are responsible for activity in your workspace.
- Workspace owners decide who joins their workspace and what role they have, and are responsible for those members’ use of the service.
- Tell us promptly at alex.armenciu@gmail.com if you suspect unauthorized access.
Your websites and your visitors
When you install Kharon Labs on a website, you are responsible for it. In particular you agree to:
- Install it only on websites you own or are authorized to change.
- Tell your visitors about it in your own privacy notice, and obtain any consent the law requires for cookies, measurement and personalization, including through your consent banner.
- Not use the service to identify individuals, to make decisions with legal or similarly significant effects on them, or to target people based on sensitive characteristics such as health, religion, sexual orientation or ethnicity.
For visitor data we process on your behalf, we act as your processor under your instructions, as described in our privacy policy. If you need a data processing agreement, contact us.
Acceptable use
You will not, and will not let anyone else:
- Use the service to publish content that is unlawful, deceptive, defamatory, or infringes others’ rights.
- Send malware, attack, probe or overload the service, or get around its security or usage limits.
- Access another customer’s data, or share your API keys outside your organization.
- Resell the service, or copy, reverse engineer or build a competing product from it, except as the law allows.
We may suspend access that breaks these rules or puts the service or other customers at risk.
Your content
You keep all rights in the content you add (headlines, copy, audiences, goals and the like) and the data collected from your websites. You give us a license to host, copy, process and display it only as needed to run the service for you. You confirm you have the rights to the content you publish through it.
Our property
The service, its software and the Kharon Labs name and marks belong to us. Apart from the right to use the service under these terms, nothing transfers to you. If you send us feedback, we may use it without obligation to you.
Fees
Using Kharon Labs needs a paid plan; there is no free tier or trial. Plans are billed in advance each period through Stripe at the price shown at checkout, and renew until you cancel in the billing portal; cancelling stops the next renewal. When a plan ends the console pauses and your site shows the default copy you last published, without personalization. We will tell you before a price changes, and the change applies from your next period.
If you let an AI agent act in your account, you are responsible for what it does there, as if you had done it. Agents can never publish or pay for you: those steps are always yours.
Ending your use
You can stop using the service and ask us to delete your account at any time. We may suspend or end your access if you materially break these terms, if the law requires it, or, with reasonable notice, if we discontinue the service. When your account ends, we delete your data as described in the privacy policy. Sections that by their nature should survive, such as ownership, disclaimers and limits of liability, survive.
Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Company identification is probabilistic: we do not promise that a visitor is matched to the right company, that personalized content will improve your results, or that the service will be uninterrupted or error free.
Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising from these terms or the service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars. These limits do not apply where the law does not permit them.
Indemnity
You will defend and hold us harmless from claims by third parties arising from your content, your websites, or your breach of these terms or of the law, including claims by your visitors about consent.
Changes to these terms
We may update these terms. We will post the new version here and update the date above, and for a material change we will tell account holders by email or in the console at least 30 days before it takes effect. Continuing to use the service after that means you accept the change.
General
These terms are governed by the laws of the State of Delaware, USA, and disputes go to the courts there, unless the law where you live gives you the right to bring proceedings at home. If part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. You may not transfer these terms without our consent; we may transfer them to a successor. These terms and the privacy policy are the whole agreement about the service, unless we have signed a separate agreement with you, which then takes precedence.
